1. Acceptance of Terms

By downloading, installing, or using Budgeting365 (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the App.

2. Eligibility

You must be at least 18 years of age to use Budgeting365. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement under the Indian Contract Act, 1872, or the applicable laws of your jurisdiction.

If you are under 18, you may not use the App. We do not knowingly collect or solicit any information from anyone under 18.

3. Description of Service

Budgeting365 is a personal finance management application that allows you to track expenses, manage budgets, monitor accounts, set savings goals, and generate financial reports. All financial data is stored locally on your device and encrypted with AES-256.

The App is available as a free version with advertisements served by Google AdMob. An optional one-time in-app purchase (“Remove Ads”) is available to permanently disable all advertisements. The App requires an internet connection solely for displaying ads in the free version; your financial data is never transmitted over the network.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial financial management purposes, subject to these Terms.

Important: Since all data is stored exclusively on your device, you are solely responsible for maintaining backups. If you uninstall the App, lose your device, or perform a factory reset, your data will be permanently lost. We have no ability to recover it.

We strongly recommend that you regularly export your data using the built-in CSV export feature.

You retain full ownership of all data you enter into the App. AAS Codeworks claims no rights, title, or interest in your personal or financial data. Our intellectual property rights (Section 10) apply only to the App itself, not to your data.

Since all data is stored exclusively on your device and we have no access to it, we cannot verify, validate, or be held responsible for the accuracy of any financial information you enter or any decisions you make based on it.

7. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be error-free, uninterrupted, or free from vulnerabilities. While we implement strong encryption (AES-256-CBC), we cannot guarantee absolute security against all possible attack vectors, particularly if your device is compromised. Since Budgeting365 is fully offline and we operate no servers or internet services, we have no control over your data, your device, or your network — all responsibility for data safety rests with you.

8. Limitation of Liability

To the maximum extent permitted by applicable law (including the Information Technology Act, 2000 and the Indian Contract Act, 1872), in no event shall AAS Codeworks, Budgeting365, or its affiliates be liable for any:

Our total liability, if any, shall not exceed the amount you paid for the App. If you have paid for the “Remove Ads” in-app purchase or any other premium features, our total liability shall not exceed the total fees paid by you in the 12 months preceding the claim.

9. Assumption of Risk & Use at Your Own Risk

You expressly understand and agree that your use of Budgeting365 is entirely at your own risk. The App is provided on an “as is” and “as available” basis.

AAS Codeworks does not guarantee that the App will be uninterrupted, error-free, secure, or suitable for your specific purposes. You are solely responsible for:

Since Budgeting365 is a fully offline app and AAS Codeworks does not have access to your data, does not operate any servers, and does not control your device or internet connection, to the maximum extent permitted by applicable law, AAS Codeworks shall not be responsible or liable for any loss, damage, or harm of any kind arising from or related to your use or inability to use the App, including but not limited to data loss, financial loss, device issues, or third-party access to your device, except where such liability cannot be excluded under applicable law.

By using the App, you acknowledge that you assume full responsibility for all risks associated with its use.

10. Intellectual Property

All intellectual property rights in the App, including but not limited to source code, design, graphics, logos, and documentation, are owned by AAS Codeworks and are protected by applicable intellectual property laws, including the Indian Copyright Act, 1957.

Budgeting365 incorporates open-source software components licensed under various permissive licences (BSD, MIT, Apache 2.0). These components remain the property of their respective authors. A full list of open-source licences is available within the App or upon request by contacting us.

Budgeting365™ and all associated branding are proprietary marks of AAS Codeworks. You may not use them without prior written consent.

11. Updates & Modifications

We may release updates to the App from time to time. These updates may include bug fixes, security patches, new features, or changes to existing features. Continued use of the App after an update constitutes acceptance of any changes.

We reserve the right to discontinue the App. In such an event, we will provide at least 30 days’ notice through the App’s Play Store listing or our website, during which time you should export your data using the built-in export features.

12. Termination

You may stop using the App at any time by uninstalling it from your device. We reserve the right to terminate or suspend access to the App if we determine, in our sole discretion, that you have violated these Terms.

Upon termination, all licences granted to you under these Terms will immediately cease. Sections 5, 6, 7, 8, 9, 10, 14, and 18 shall survive termination.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to:

Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

If you are located in the EU/EEA or UK, nothing in these Terms limits your rights under applicable consumer protection laws in your jurisdiction. If mandatory local laws grant you additional rights, those rights apply.

Before initiating any legal proceedings, you agree to attempt to resolve the dispute informally by contacting us at support@budgeting365.com. We will make reasonable efforts to resolve your concern within 30 days.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated “Last updated” date.

For material changes that significantly affect your rights or obligations, we will display a notice within the App requiring your affirmative acknowledgment before continued use. For minor or clarifying changes, your continued use of the App after the changes are posted constitutes acceptance.

17. Force Majeure

Neither party shall be liable for any delay or failure to perform obligations under these Terms due to events beyond reasonable control, including but not limited to natural disasters, government actions, changes in law, platform provider decisions (such as Google removing or restricting the App), pandemic, civil unrest, internet outages, or other circumstances that could not have been reasonably foreseen or prevented.

You agree to indemnify and hold harmless AAS Codeworks, its owners, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from:

19. Company Dissolution or Transfer

In the event of a merger, acquisition, dissolution, or asset transfer involving AAS Codeworks, these Terms will continue to apply. Since all user data is stored exclusively on your device and never on our servers, no user data will be included in any such transfer.

The new owner or successor would assume only the intellectual property rights to the App itself, not any user data. Your data remains on your device, under your control, regardless of any change in ownership.

20. Privacy Policy

Your use of the App is also governed by our Privacy Policy, available at https://budgeting365.com/privacy-policy.html. In the event of any conflict between these Terms and the Privacy Policy, the Privacy Policy shall prevail on matters relating to data privacy and protection.

21. Waiver

Failure by AAS Codeworks to enforce any provision of these Terms shall not constitute a waiver of that provision or the right to enforce it at a later time. Any waiver of a breach shall not constitute a waiver of any subsequent breach.
